Fourth Circuit Court of Appeal to decide open meetings law violations, Entergy Gas Plant after hearing oral arguments today.

​Fourth Circuit Court of Appeal Honorable Judges James McKay, Paula Brown and Dale Atkins heard oral arguments on appeals of Judge Piper Griffin’s two judgments that included a decision to void the New Orleans City Council’s approval of Entergy’s gas plant for open meetings law violations.

​​Entergy joined the City Council in arguing against New Orleans community and public interest organizations, who were represented by attorneys from the Deep South Center for Environmental Justice, Earthjustice, Green Justice Legal and Loyola Law School.

Entergy New Orleans, the city’s electric and gas utility, filed two lawsuits on Friday over recent decisions by the New Orleans City Council, which serves as the company’s regulator. 

One of the suits challenges the council’s November decision to lower the profit rate the company can collect from New Orleans customers. The other challenges a $1 million fine the council levied on the company for its “inaction and omissions in mitigating” the thousands of power outages the city experiences every year.

A battle is brewing over a court judgment that threw out the City Council’s approval of the Entergy gas plant for violation of Louisiana Open Meetings Law. The violation occurred at two controversial Council meetings that involve Entergy’s deceptive use of paid actors to fill up a meeting room and speak from scripts as though they were concerned residents. At these meetings, numerous New Orleans residents were denied the opportunity to comment on Entergy’s application for a new gas plant in New Orleans East.

If you live in New Orleans, you know how often the electricity goes out. Advisers hired by the New Orleans City Council found that, between June 2016 and May 2017, there were a total of 2,599 outages and roughly half lasted two hours or more. 

Sure, some of this can be blamed on heat, flooding and storms, but more than half the power outages reported were unrelated to weather. More than a third resulted from equipment failure.

When I lived in small village in Vietnam, there was not much my community could do to combat climate change due to a lack of technology and education regarding the climate crisis. It was painful to see our planet suffer and not be able to do anything about it.
​
I’ve lived in New Orleans for two years now. This city inspires me with the way the community embraces so many cultures. Our New Orleans culture is directly at risk with the current climate crisis. Not only is the community’s way of life at risk but the vast and complex ecosystem that surrounds New Orleans is as well.

This means addressing the root cause of the problem rather than its symptoms, using innovation to your advantage, and above all looking to many different perspectives for solutions.

​These ideals are exemplified by the Resilient and Renewable Portfolio Standard (R-RPS), a plan proposed earlier this year to fight the climate crisis in New Orleans. New Orleans is uniquely vulnerable to climate change.

​Montpelier, VT – Solar and battery storage technologies that provide clean, reliable backup power are cost-effective for many critical community facilities in the Southeast, according to Clean Energy Group’s report series, “Resilient Southeast: Exploring Opportunities for Solar+Storage in Five Southeastern Cities,” released today in partnership with regional nonprofit partners details a first-of-its-kind economic analysis evaluation for solar PV and battery storage (solar+storage) in the region. When the economic value of resilience is accounted for, solar+storage was proven to be a positive investment for all locations and building types examined.

Entergy ignores judgment that voids City Council approval of gas plant and raises the cost from $210 million to nearly $700 million.

​The rate that New Orleans residents will pay on Entergy bills will be taken up by the City Council utility committee when it meets at 10:00 am on Wednesday, October 23 in Council Chambers. Advocacy groups warn that the rate plans recommended by Entergy and advisors to the City Council include expensive charges that would be billed to Entergy customers at a later date.

Our aging energy infrastructure and equally antiquated utilities have failed to adapt to severe weather. Now, risks to our electric grid are getting worse and the consequences are more serious because of climate disasters.

We can't take reliable electricity service and grid resilience for granted. Electricity service is essential to modern life and survival when severe weather strikes. But how we build our grids and the resources we rely upon determine affordability and reliability. And we have built our electric grids to be large, brittle, expensive and vulnerable.
